Will Haeger Takes A Division at Mallory Cup

The Mallory Cup is one of the most prestigious regattas in high school sailing. Twenty teams pre-qualify for participation in this Spring Doublehanded college-style event. Beulah's Will Haeger won A division sailing for Lake Forest HS in IL. With his B skipper, Haeger's team finished an overall fourth. Winning the event was Catholic Central from CA with another Beulah connection. Many of you recall Mary Ellen Brigden of ILYA X Champ fame. Nevin is her accomplished son who along with Will has made a name for himself on the HS scene.
Will sails a C boat during his summers and is a past top junior at the ILYA C champs in Okoboji. He won the MIR C event last summer beating father Kent - only this once.
Collegiate Nationals nears - May 25th start
collegiate nationalsCoaches and sailors from the ILYA will compete next week in the 2010 Collegiate Nationals. The UW lakefront is preparing for the event with boats on loan from many of our clubs: Pewaukee, Oshkosh, Beulah, Mendota, Cedar, LaBelle, Geneva and the Barkow Family. Harken will parade its new boat. Summerset Marine has generously donated a 23 foot inflatable which will serve as the rotation boat. Race committee names will also be familiar: Chip Mann, Russ Ackley, Mark Prange, Terry Bischoff and Dennis Gazana, John Porter, Bre Schmidt, Suzi Reese, Matt and Bekka Schmidt, David and Candace Porter. And to top it off, our ILYA members donated over $20,000 to make this an extravaganza to remember. Merchandise thanks to the Fredman and Kiernan families. The list goes on and on for our Midwest supporters.

Does your lake association (not a lake district)hold a tax exemption from the IRS? If so, make sure that you file Form 990 by May 17 (next Monday!) or you may lose that exemption, forcing you to reapply preventing you from collecting deductible contributions.


In 2007 Congress passed a law that required all tax-exempt organizations to file an annual return. This changed a longstanding policy that organizations raising $25,000 or less in annual receipts were not required to take any action. Starting in 2007, those organizations were required to file at least a postcard return with the IRS. According to a recent story in the Non Profit Times, nearly 25% of non-profits in the United States face loss of their tax exemption if they do not file a return for 2009.

The IRS will give groups some leeway if they miss the deadline, right? NO - THE LAW GIVES THEM NO CHOICE BUT TO REVOKE THE TAX EXEMPTION.

Any organization that fails to file returns for three consecutive years automatically loses its tax exemption. According to the Non-Profit Times story, the IRS pressured Congress to give them leeway to simply suspend such organizations, but the law gives the Service no choice - ANY ORGANIZATION THAT DOES NOT FILE A 990 FOR THREE CONSECUTIVE YEARS AUTOMATICALLY LOSES THEIR EXEMPTION. To get the exemption back involves going through the entire time-consuming and costly application process again, and donations to revoked organizations would not be tax-deductible until the exemption was regained.

Okay, what do I have to do, and when?

The law requires organizations with $25,000 or less in annual receipts (including organizations that had $0 in receipts), to file Form 990-N, an electronic postcard filed online that asks for basic information about the organization. Organizations with more than $25,000 in revenue are required to file either Form 990-EZ or the full Form 990, depending on the amount of revenue. All of these forms are available from the IRS website's official page on the revocation issue, which you can find here.

These filings are all due four and a half months after the end of the organization's fiscal year. Most organizations run on the calendar year and thus need to file by May 15. Because in 2010 the 15th falls on a weekend, the actual deadline this year is May 17. Organizations can receive an extension for filing the form by filing Form 8868, but that form must also be postmarked no later than May 17.

How do I know if my organization is in jeopardy of losing its exemption?

First, if your return is postmarked by Monday, May 17, which it should be anyway, it won't matter because you'll avoid having three consecutive years without filing since 2007. But, you can check your status on this handy website, here.
